Today, April 4, 2012, Bruce MacDonald, the Convening Authority for Military Commissions, referred to a military commission charges against five detainees for their alleged involvement in the 9/11 attacks: Khalid Sheikh Mohammed, Walid Muhammad Salih Mubarak Bin 'Attash, Ramzi Binalshibh, Ali Abdul Aziz Ali, and Mustafa Ahmed Adam al Hawsawi.

The case was referred as a capital case (meaning the accused could be sentenced to death if convicted) for all five individuals. Mr. MacDonald has made the decision to "refer," which means to send the case to a panel of at least twelve members, whose function is analogous to jurors in a federal or state court. The case was also referred as a joint trial, meaning that all five of the accused will be tried together, unless the military judge later determines that any or all of the accused should be tried separately.

We will seek to arraign the accused individuals in front of a military judge at Guantanamo Bay, Cuba, within 30 days of service of the referred charges as required by law. At this hearing, the charges will be read, and the accused will be asked to enter pleas to the charges. The military judge may also set a timeline for the parties to provide required discovery, establish due dates for filing legal motions, and schedule additional pre-trial hearings.

The US has formally sent to trial five suspected al-Qaeda militants believed to have planned the 9/11 terror attacks. The five Guantanamo Bay inmates, including alleged mastermind Khalid Sheikh Mohammed, will be tried by a military commission.

They will face charges including terrorism, hijacking, conspiracy, murder and destruction of property. They could face the death penalty if found guilty, the Pentagon confirmed.

A total of 2,976 people died in the attacks.

The decision to refer the charges to a military commission comes after a legal wrangle over where the five men would face justice.

The Obama administration initially tried to move their trial into US civilian courts, but reversed its decision in April 2011 after widespread opposition.

My only comment on this, "IT'S ABOUT DAMN TIME!"  Let them fry.

But I submit that this is an election ploy. Look at the timing!

Plus, this is a distraction from all of the stepping in it that Obama has done the past few weeks: Trayvon Martin, Russian President, SCOTUS.

I'm uncomfortable with the timing of this. And I don't like where it's going. The last thing we need right now is more jingoism. Our entanglements in Afghanistan and Iraq are the testimonies to the failure of the neocons. The failure of going to war with what you have, without raising taxes, selling bonds,... something,... Anything! It was and has been a terrible failure, and Obama has been unable to raise the taxes , to pay the bills.

You have to raise money to raise an army, let alone pay off prior military adventures. If you do not believe that, then eventually you will be unable to then ever raise an army. Right?

Armies are made of human beings who require salaries, and pensions, and sometimes, as you guys bring up here a lot, all sorts of special social treatment. And you are absolutely right to bring that up.

How the *&^%$#@!@#$%^&* do you propose we PAY those bills?

These had little to do with largely mythical "neocons'. And both justified retaliations have been a success.

The federal government receives revenues that are far more than enough to cover the bills of national defense.

The President wants to raise taxes out of greed, and to score points with those in his base that thrive on class-warfare rhetoric. Despite the fact that tax jikes would kick the economy in the teeth and result in lower federal revenue in the end. Thankfully, he has failed in some of these efforts to further impoverish the American public and cripple the economy.

Without unnecessary Obama tax hikes on the middle class, we "pay those bills" with a fraction of the revenue coming in. It's taken care of already.

Obama with his threats proved himself a failure at Constitional law 101. The only thing the Court needs to consider is the Constitutionality of the matter before them. Not what he demands that they consider instead of the Constitution.

On a side note, it'll be interesting to see if they really will be executed. I know the lefties are all gung-ho about executing that US soldier who killed all those Afghan civilians, but I'm not so sure they'll be pulling for KSM to get the chair. Perhaps if their great leader tells them to shut it, they will.

Most of Obama's followers may not see the significance of Obama's threat directed at SCOTUS. However, Obama has stepped in it more than once recently.

I note that, yesterday, Eric Holder issued a conciliatory statement about Obama's shooting off his mouth about what SCOTUS must and must not do.

I hope that BHO has alienated Justice Kennedy. Kennedy may cast the deciding vote in the verdict on ObamaCare. And if ObamaCare goes down, so do Obama's chances to get re-elected.

Finally, but at least the trial is taking place at Gitmo and not in New York. It should have happened years ago and they should have been executed by now.

It was a quite competant administration that decided to retaliate against both terrorist regimes. A decision made by traditional conservatives and supported even by much of the left. Actual neocons are rare and have little power. Almost like unicorns.

The succesful retaliation ended the terrorist threat and has made more 9/11's very remote. As for why the Taliban are still there, ask the actual incompetant administration which places more priority on retreat/surrender than eliminating the last of the remaining terrorists. Obama campaigned on his ignorance and contempt for foreign policy, and it shows.

Jersey: no one 'wanted' these wars. The terrorists forced them on us whether we wanted them or not. Nothing to do with mythical 'neocons'. No one 'knows' what you claim as it simply did not happen. I am referring to real history, not your conspiracy theory. Your silly claims are myths because they do not match actual history.

You would do well to remember also the strong quotes from Bill Clinton and other liberals who spoke of the need to fight back against the terrorists in Iraq and elsewhere. No 'neocon' he. Nor are Bush and Cheney... and they ordered the invasions as a last resort after giving the terrorists a very long time to stop their aggresions.

If it wasn't for Holder & CO being so incompetent and fighting against justice being done in the military then this military trial along with the sentence would have been carried out under the Bush administration.

MK,I hope they are executed and I don't believe BHO can do a darn thing to stop it. And let the Left cry their crocodile tears. These men are responsible for the deaths of many, many innocent people, including children.

Magpie, indeed. But right now, all I want is to see these particular men answer for their crimes and punished by death. And I am all for bringing all of our troops home. It's time.

AOW, we can pray and hope that's exactly what will happen. Obama cannot threaten the SCOTUS, they will do their job, or at least I hope they will.
